Terms of Service

Terms of Service v3.0 — Revised per attorney review rounds 1 and 2. Effective Date: July 27, 2026.

Please read these Terms of Service carefully before using Archer Food Genius. By accessing or using archerfoodgenius.com or any AFG application, you agree to be bound by these Terms. If you do not agree, do not use the Service.

Description of Service

Archer Food Genius is an informational food research tool. The Service reads listed ingredients and nutrition facts from food product labels you photograph and cross-references them against publicly available nutrition and food-science databases including the FDA, USDA, NIH, CDC, and peer-reviewed scientific research to provide plain-English information about food products. The Service also provides side-by-side comparisons of food products, fact-checking of nutrition claims against peer-reviewed literature, meal suggestions with sourced nutritional reasoning, and allergen identification based on listed ingredients.

No Medical Advice and Regulatory Status

THE SERVICE DOES NOT PROVIDE MEDICAL ADVICE, MEDICAL DIAGNOSIS, DIETARY COUNSELING, MEDICAL NUTRITION THERAPY (MNT), DIETARY PRESCRIPTIONS, OR CLINICAL NUTRITION GUIDANCE. ALL CONTENT IS FOR GENERAL INFORMATIONAL AND EDUCATIONAL PURPOSES ONLY.

ARCHER FOOD GENIUS IS NOT INTENDED TO DIAGNOSE, TREAT, CURE, PREVENT, MONITOR, OR MITIGATE ANY DISEASE OR MEDICAL CONDITION AND IS NOT INTENDED TO FUNCTION AS A MEDICAL DEVICE UNDER APPLICABLE LAW.

THE SERVICE IS NOT A SUBSTITUTE FOR PROFESSIONAL MEDICAL ADVICE, DIAGNOSIS, OR TREATMENT. IF YOU HAVE QUESTIONS ABOUT A MEDICAL CONDITION, DIETARY RESTRICTION, OR NUTRITIONAL NEED, CONSULT A QUALIFIED PHYSICIAN, REGISTERED DIETITIAN, OR OTHER LICENSED HEALTHCARE PROFESSIONAL.

ARCHER FOOD GENIUS LLC AND ITS FOUNDER ARE NOT LICENSED HEALTHCARE PROVIDERS, REGISTERED DIETITIANS, OR MEDICAL DEVICE MANUFACTURERS. INFORMATION PROVIDED REFLECTS PUBLICLY AVAILABLE RESEARCH DATABASES AND DOES NOT CONSTITUTE PROFESSIONAL ADVICE OF ANY KIND.

Artificial Intelligence Disclosure

Archer Food Genius uses artificial intelligence to summarize, synthesize, and explain publicly available nutrition research and food label information. AI-generated outputs are automatically produced and may contain errors, omissions, hallucinations, or incorrect interpretations of source material.

YOU SHOULD INDEPENDENTLY VERIFY IMPORTANT INFORMATION BEFORE RELYING ON ANY AI-GENERATED OUTPUT. AI-GENERATED SUMMARIES DO NOT CONSTITUTE PROFESSIONAL ADVICE AND SHOULD NOT BE USED AS THE SOLE BASIS FOR FOOD PURCHASING DECISIONS, DIETARY CHANGES, OR HEALTH-RELATED ACTIONS.

Certain outputs are generated through automated AI processing. These outputs are informational only and are not intended to make legal, medical, insurance, employment, or healthcare decisions on your behalf.

Food scan images and text queries you submit are transmitted to Anthropic PBC for AI processing. AFG does not use customer data to train its own AI models. Anthropic's API data handling policies provide that data submitted via the API is not used to train Anthropic's models by default. Review Anthropic's current policies at anthropic.com.

No Professional Relationship

Use of the Service does not create a physician-patient relationship, dietitian-client relationship, fiduciary relationship, or any other professional relationship between you and Archer Intel LLC or its founder. No communication through the Service constitutes professional medical, dietary, legal, or financial advice.

Database Limitations and AI Output Limitations

THE SERVICE RELIES ON THIRD-PARTY DATABASES AND ARTIFICIAL INTELLIGENCE THAT MAY PRODUCE INCOMPLETE, INACCURATE, OR OUT-OF-DATE INFORMATION. ARCHER FOOD GENIUS MAKES NO REPRESENTATION OR WARRANTY THAT THE INFORMATION PROVIDED IS ACCURATE, COMPLETE, CURRENT, OR SUITABLE FOR ANY PARTICULAR PURPOSE.

Specifically, you acknowledge that:

  • database information may not reflect the most current product formulation;
  • the Service cannot verify whether a product has been reformulated;
  • NOVA scores and allergen classifications are derived from third-party databases and may not reflect the actual product in your possession;
  • AI-generated summaries may contain hallucinations or inaccurate outputs and you agree to independently verify all food label information before consumption; and
  • ingredient proportion inferences are based on legal label ordering requirements and actual proportions may differ.

Allergen Detection Limitations

THE SERVICE'S ALLERGEN DETECTION FEATURE IS FOR INFORMATIONAL GUIDANCE ONLY AND IS NOT A MEDICAL DEVICE. THE SERVICE CANNOT AND DOES NOT GUARANTEE THE DETECTION OF ALL ALLERGENS OR CROSS-CONTAMINATION RISKS.

The Service matches listed ingredients against a database of known allergens. It cannot detect physical cross-contamination, undocumented manufacturing cross-contact, shared equipment risks, unlisted recipe alterations, mislabeled products, or allergens present in complex ingredient names or derivatives.

IF YOU HAVE A SEVERE FOOD ALLERGY, DO NOT RELY SOLELY ON THIS SERVICE. ALWAYS PHYSICALLY INSPECT THE PRODUCT LABEL AND CONSULT A HEALTHCARE PROFESSIONAL BEFORE CONSUMING ANY PRODUCT. BY USING THE ALLERGEN DETECTION FEATURE, YOU EXPRESSLY RELEASE ARCHER FOOD GENIUS FROM ANY AND ALL LIABILITY FOR ALLERGIC REACTIONS, ANAPHYLAXIS, INJURY, OR DEATH ARISING FROM UNDISCLOSED LABEL CHANGES, CROSS-CONTAMINATION, OR ANY OTHER CAUSE NOT REFLECTED IN THE PUBLICLY AVAILABLE INGREDIENT DATABASE.

Data Input Liability

THE ACCURACY OF THE SERVICE'S OUTPUT IS DEPENDENT ON THE QUALITY AND ACCURACY OF THE INFORMATION YOU PROVIDE. ARCHER FOOD GENIUS IS NOT RESPONSIBLE FOR INACCURATE OR INCOMPLETE RESULTS CAUSED BY UNCLEAR, MISLEADING, OR INCORRECT USER-PROVIDED PHOTOGRAPHS, TEXT, OR OTHER INPUTS. You bear sole responsibility for verifying the accuracy of any information before acting on it, including physically inspecting the product label.

Eligibility and Account Registration

You must be at least 18 years of age to use the Service. You are responsible for maintaining the confidentiality of your account credentials. Notify us immediately of any unauthorized use at support@archerfoodgenius.com.

Subscription, Billing, and Cancellation

Free Tier: permits up to three (3) scans per week at no charge.

Paid Subscription: available at the prices listed on archerfoodgenius.com at the time of purchase, billed monthly or annually in U.S. dollars.

Cancellation and Refund Policy: Subscriptions may be canceled at any time through account settings or by contacting support@archerfoodgenius.com. Cancellation takes effect at the end of the current billing cycle. Payments are non-refundable, and no prorated refunds or credits will be issued for partially used subscription periods, except as required by applicable law.

Price Changes: We reserve the right to change subscription pricing upon thirty (30) days written notice to your registered email address.

Intellectual Property

The Service, including its design, code, content, branding, and Credibility Score methodology, is owned by Archer Food Genius LLC and protected by applicable intellectual property laws. You retain ownership of photographs you submit. By submitting content, you grant us a limited, non-exclusive, royalty-free license to process and display that content solely to provide the Service to you.

Ownership of AI-Generated Output

AI-generated outputs are provided for your personal, non-commercial use. You may not resell or commercially redistribute AI-generated outputs, represent them as your own original work in a commercial context, or use them to train or benchmark competing AI models. Ownership of AI-generated content may be subject to evolving legal interpretation.

Privacy

Your use of the Service is subject to our Privacy Policy at archerfoodgenius.com/privacy, incorporated into these Terms by reference.

Prohibited Uses

You agree not to:

  • use the Service for any unlawful purpose;
  • use the Service to provide medical advice or dietary prescriptions to third parties;
  • attempt to reverse engineer or disassemble the Service or its AI models;
  • attempt to extract or reconstruct the Service's scoring algorithms through repeated queries, automated testing, or model extraction techniques;
  • use automated means including bots, scrapers, crawlers, or prompt injection techniques to access or exploit the Service without our express written permission;
  • use the Service for benchmarking competing AI systems without our express written permission;
  • resell or commercially exploit the Service or its output without our express written permission;
  • submit false or fraudulent information; or
  • use the Service in violation of U.S. export control laws or sanctions.

Disclaimers of Warranty

THE SERVICE IS PROVIDED AS IS AND AS AVAILABLE WITHOUT WARRANTIES OF ANY KIND. TO THE FULLEST EXTENT PERMITTED BY LAW, ARCHER FOOD GENIUS DISCLAIMS ALL WARRANTIES INCLUDING IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, ACCURACY, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, OR THAT AI-GENERATED OUTPUTS WILL BE ACCURATE OR COMPLETE.

Limitation of Liability

TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL ARCHER FOOD GENIUS BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES ARISING OUT OF OR RELATED TO YOUR USE OF THE SERVICE, INCLUDING DAMAGES ARISING FROM RELIANCE ON AI-GENERATED OUTPUTS, ALLERGEN DETECTION FAILURES, OR DATABASE INACCURACIES.

ARCHER FOOD GENIUS'S TOTAL CUMULATIVE LIABILITY SHALL NOT EXCEED THE GREATER OF (A) THE TOTAL AMOUNT YOU PAID IN THE TWELVE (12) MONTHS IMMEDIATELY PRECEDING THE CLAIM, OR (B) ONE HUNDRED DOLLARS ($100.00). THIS LIMITATION APPLIES TO ALL CAUSES OF ACTION IN THE AGGREGATE.

Indemnification

You agree to indemnify, defend, and hold harmless Archer Intel LLC, its officers, directors, employees, and agents from and against any claims, liabilities, damages, losses, and expenses including reasonable attorneys fees arising out of or connected with your use of the Service, your violation of these Terms, your violation of any third-party right, or any claim that information you provided caused damage to a third party.

Force Majeure

Archer Intel LLC shall not be liable for any failure or delay in performance caused by circumstances beyond its reasonable control, including acts of God, natural disasters, pandemic, war, government action, power outages, internet disruptions, third-party service provider failures, or cyberattacks.

Export Controls

You agree not to use the Service in violation of any applicable U.S. export control laws, regulations, or sanctions including the Export Administration Regulations, ITAR, and OFAC regulations. You represent that you are not located in, organized under the laws of, or a resident of any country subject to U.S. embargo or comprehensive sanctions.

DMCA and Copyright Complaint Procedure

If you believe that content on the Service infringes your copyright, please send a written notice to support@archerfoodgenius.com containing:

  • a description of the copyrighted work claimed to be infringed;
  • a description of the material on the Service claimed to be infringing and its location;
  • your contact information;
  • a statement that you have a good faith belief that use of the material is not authorized by the copyright owner;
  • a statement that the information in the notice is accurate; and
  • your physical or electronic signature.

We will respond to valid DMCA notices in accordance with applicable law.

Governing Law and Dispute Resolution

These Terms shall be governed by the laws of the State of Florida. Venue for any dispute not subject to arbitration shall reside exclusively in the state or federal courts located in Broward County, Florida.

ARBITRATION AND CLASS ACTION WAIVER: Any dispute arising out of or relating to these Terms or the Service shall be resolved by binding arbitration administered by the American Arbitration Association under its Commercial Arbitration Rules. YOU AGREE TO RESOLVE ALL DISPUTES ON AN INDIVIDUAL BASIS AND EXPRESSLY WAIVE ANY RIGHT TO BRING OR PARTICIPATE IN A CLASS ACTION, CLASS ARBITRATION, OR REPRESENTATIVE PROCEEDING.

Changes to These Terms

We will notify you of material changes by posting the updated Terms at archerfoodgenius.com/terms and sending notice to your registered email address at least thirty (30) days before the changes take effect.

Termination

We reserve the right to suspend or terminate your access at any time, with or without cause. Sections 2, 3, 4, 5, 6, 7, 11, 14, 15, 16, 18, and 20 shall survive termination.
